If you are placed under arrest or otherwise detained, you should know that you have certain constitutional rights.  Talk to a lawyer before you inadvertently waive these rights.  A lawyer can give the advice you need and provide the advocacy you deserve to fight arrest or conviction.  You should know that you have the right to:

  • REMAIN SILENT.  â€‹Police and prosecutors will use anything you say to incriminate you in a court of law.  It is in your best interest to remain silent until your attorney arrives or until you hire an attorney or one is appointed to you.
  • HIRE A LAWYER.  If you are suspected or being investigated for a crime then you need to hire an attorney as soon as possible.  Know your rights.  Exercise your rights.  Even if you cannot afford a lawyer, our system of justice requires that one be appointed to you.  
  • REFUSE AN UNLAWFUL SEARCH OF YOUR PERSON, YOUR HOME OR YOUR VEHICLE.  If you refuse a search, the police have to obtain a warrant from a judge before they can search you or your property.  The warrant will have to state precisely what police are hoping to uncover.
